If you are working and your earnings are more than $1000.00 per month (for 2010), you generally cannot be considered disabled.  If you can do the kind of work you have done in the last 15 years prior to becoming disabled, you generally will have the claim denied.  If you cannot engage in substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months, you should have a case.
